Capital Management Services tells it like it is, right on their site. On their front page, Capital Management Services states their philosophy, “TIME IS MONEY.” The debt collection company wastes no time in going to whatever lengths necessary to get money from consumers. Capital Management Services collects many different kinds of debt, like retail charge cards, bankcards, overdraft checking, auto loan deficiencies, and telecommunications. They can go after debts that have been dismissed by bankruptcy courts. Moreover, the debt collection agency boasts that its executive staff has overseen the collection of $3 billion of debt. It is difficult to imagine that a company could collect that much devoid of at least bending the rules some of the time. Indeed, since January 1, Capital Management Services has been named as a defendant in 24 federal lawsuits alleging that the company violated the Fair Debt Collection Practices Act.
If you have been harassed by Capital Management Services, you undoubtedly want to stop the harassment. That means knowing your rights. One thing you need to understand is that Capital Management Services devotes lots of time tracking people down. They will often use publicly available databases, online sources, and other means to find your address and phone number. Regardless of whether they can not easily locate you, Capital Management Services could find your family members, friends, and coworkers.
The law allows Capital Management Services to get hold of other people in an attempt to find you, even so the FDCPA lays down specific guidelines. Capital Management Services may get hold of someone other than you for one reason only – which is to locate you. Should they already know your contact information, all third-party contact is forbidden. When Capital Management Services calls anyone apart from you, the person calling must identify himself and say that he’s wanting to locate you, but he doesn’t need to say whom he’s working for unless of course he’s asked. He can’t tell the individual he’s talking to that you owe any debt, and he can’t contact more than once unless the individual he’s talking to asks him to do so, or if he believes that the individual has information that’s more current. If he communicates by mail, he can not send a postcard or indicate in any way that he’s a debt collector. If the individual calling you has broken any of these provisions, it’s the perfect time to stop Capital Management Services harassment.
